Terms of Service

Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the MagicBG website and services (the "Service"). The Service is operated by Hicham ELJLAIDI, a sole proprietorship trading as "MagicBG" ("us", "we", or "our"). By using the Service you are contracting with Hicham ELJLAIDI.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to any part of these Terms, you may not access or use the Service. You confirm that you are of legal age and, if you use the Service on behalf of an organisation, that you have authority to bind it.

1. Description of Service

MagicBG provides image tools and AI listing features. The image editing tools — including background removal — run in your browser, so those images are processed on your device. The AI features (photo analysis, listing copy generation and AI scene generation) require an account and process your submitted content on a remote AI provider. We also offer a paid subscription, MagicBG Pro, with batch processing, higher-quality cutouts, background replacement, marketplace presets and advanced export. We additionally provide blog content, tutorials, and free utility tools.

2. Use of the Service

The free tier of the Service is provided free of charge for personal and commercial use, subject to these Terms and to fair-usage limits. MagicBG Pro is provided on a paid subscription basis as described in Section 3. You are responsible for your use of the Service, for maintaining the confidentiality of your account credentials, for keeping your account information accurate, and for any content you process using the Service.

You may not use the Service to:

• Process content you do not have the legal right to use, including copyrighted images, trademarks, or images of people without their consent where such consent is required.
• Create, distribute, or promote deceptive, fraudulent, misleading, or illegal content.
• Reverse engineer, decompile, disassemble, or attempt to extract source code or underlying models from the Service.
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure, including probing, scanning, scraping, or introducing malware.
• Use any automated system, including robots, spiders, or offline readers, to access the Service in a manner that sends more request messages than a human could reasonably produce.
• Resell, redistribute, or share Pro access, or circumvent usage limits or technical restrictions.
• Use the Service for any purpose that is unlawful or prohibited by these Terms.

3. MagicBG Pro — Subscriptions, Billing and Cancellation

MagicBG Pro is offered on a monthly or annual subscription. Current prices are shown on our Pricing page and are charged in advance, inclusive or exclusive of applicable taxes as displayed at checkout. Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled.

You may cancel at any time from your account page or via paddle.net. Cancellation stops future renewals; your Pro access continues until the end of the paid period. Refunds are governed by our Refund Policy. Payment, billing, tax, cancellation and refund mechanics are also governed by Paddle's Buyer Terms. If a renewal payment fails, we may suspend Pro features after a reasonable retry period.

Merchant of Record: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment methods: Depending on your country and the checkout you choose, payment may be taken through Paddle's secure checkout, which supports major credit and debit cards, PayPal, and other local payment methods. Card details are entered directly with Paddle and are never collected, processed or stored by us. Pro features are activated only after Paddle confirms a successful payment or active subscription to our servers; a failed, pending or cancelled payment does not activate Pro.

4. Your Content

You retain all ownership rights to the images and text you process using the Service. For the in-browser tools, processing happens on your device and we never receive your content. For the AI features, the content you submit is transmitted for processing solely to generate your result; we do not claim any rights to it and do not use it to train models.

By using the Service, you represent and warrant that you have the necessary rights to process any images you upload, and that doing so does not violate any third-party rights, including copyright, trademark, privacy, or publicity rights.

5. Intellectual Property

The MagicBG name, logo, branding, design, code, software, original written content, blog articles, and other materials provided through the Service are the intellectual property of MagicBG and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or exploit any of our intellectual property without our prior written consent.

6. Advertising and Third-Party Content

The Service may display advertisements provided by third-party advertising networks, including Google AdSense. We do not control the content of these advertisements and are not responsible for the products, services, or content promoted by third-party advertisers. Your interactions with third-party advertisers are governed by their respective terms and privacy policies.

The Service may also contain links to third-party websites or services that are not owned or controlled by MagicBG. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

MagicBG does not warrant that: (a) the Service will function uninterrupted, secure, or error-free; (b) the results obtained from using the Service will be accurate, reliable, or meet your requirements; (c) any errors in the Service will be corrected; or (d) the output quality of processed images will meet any specific standard.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MagicBG, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

9. Indemnification

You agree to defend, indemnify, and hold harmless MagicBG and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any copyright, property, or privacy right; or (d) any claim that your content caused damage to a third party.

10. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws applicable in the jurisdiction where MagicBG operates, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

MagicBG respects the intellectual property rights of others. If you believe that any content on the Service infringes your copyright, please contact us at contact@magicbg.org with the following information: (a) a description of the copyrighted work you claim has been infringed; (b) the location on the Service where the material is located; (c) your contact information; (d) a statement that you have a good faith belief that the use is not authorized; and (e) a statement that the information in your notice is accurate.
